Gridwise Privacy Policy

This Gridwise, Inc. (“Gridwise”) privacy policy (the “Privacy Policy”) is designed to inform you (“You”) about Gridwise’s collection, use and disclosure of information in the conduct of Gridwise’s business. The Privacy Policy applies to all users of the Gridwise platform, which provides gig-driving information, insights, and tools to customers, including ridehailing, taxi, and delivery drivers (the “Service”). The Service includes (a) the Gridwise website (the “Site”), (b) the Gridwise mobile app (the “App”), and (c) the services provided to You through the App or the Site.

We encourage You to review this Privacy Policy from time to time so that You are updated on any changes. We will indicate at the top of this Privacy Policy when it was most recently updated.

1. INFORMATION GRIDWISE COLLECTS

Overview

We collect certain types of information from and about users of our Service, including Your name and email address, information through third-party linked accounts (which may include address, phone number, license plate number, earnings data, and location data associated with completed work activities), Your device’s browser type, and vehicle make and model. Read on for details below.

How we Collect Information

When You use the Service, Gridwise collects personal information from the following sources:

  • Information you provide: This includes Information You create or information You give Gridwise on applications or other forms while using the Service, including optional data You provide Gridwise in order to use optional features of the Service and the content You choose to share with other users of the Service, as well as information You send Gridwise via any medium, including email, telephone, and social media interaction.
  • Automatically collected information: This includes information transmitted from Your mobile device or web browser, including cookie and similar tracking technology information described below.
  • Information from other sources: This includes information from third-party platforms if You choose to link Your account to the Service.

Information You Provide

  • Account information: When You create an account, Gridwise collects Your province/territory, username, email address and password. You can also add optional account details, such as an avatar.
  • Earnings, mileage and expenses: You may manually add earnings, hours and expenses, and images of Your receipts. You may also link Your Gridwise account to third-party platforms to add this type of information. Learn more at “Information from other sources” below.
  • Vehicle information: Gridwise collects details about Your vehicle, such as its make and model, when You link Your account.
  • Subscription and payment information: If You make a purchase as part of the Service, such as subscribing to Gridwise Plus, Your payment is processed by our payment processor, Stripe, or by Apple’s App Store or Google Play if you make the purchase through the App, and we do not collect or store Your full payment card number. We receive limited information from these providers, such as Your name, billing address, card type and last four digits, and transaction details such as the service purchased, purchase date, and subscription status.
  • Communications with Gridwise: If You communicate with our support team, Gridwise collects information such as Your name, contact information, and the contents of the communications You send.
  • Survey data: From time to time, Gridwise may offer You the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, de-identified form.

Automatically collected information

  • Cookies and Related Technologies: The Service may send a “cookie” to Your device. A cookie is a small piece of data that is sent to Your browser from a web server and stored on Your device. Cookies allow Gridwise to recognize You as a user when You access the Service using the same device and web browser. Gridwise uses cookies to identify which areas of the Service You have used, so the next time You use the Service, those pages may be readily accessible. Gridwise also may use this information to better personalize the content that You see while using the Service. Most browser software can be set to reject cookies. However, if You reject Gridwise’s cookies, certain functionality on the Service may not work correctly or at all.
  • Analytics Data: Gridwise may also use web beacons, pixels, anonymous ad network tags, cookies and similar technologies to collect information about Your use of the Service and the websites of selected sponsors and advertisers, to collect anonymized, aggregated auditing, research and reporting for advertisers, and to collect data related to Your use of special promotions or newsletters. The information collected by web beacons also allows Gridwise to statistically monitor how many people open Gridwise’s emails and for what purposes these actions are being taken.
  • Location Information: When You use the Service, Gridwise may collect location data from the Service that You use. Depending on the Service that You use and Your application and device settings, Gridwise may also collect Your precise or approximate location data from your device’s internet protocol (“IP”) address, GPS, or WiFi. Gridwise may also receive precise or approximate location data passed to it from third-party services or GPS-enabled devices that You have enabled. For example, when You first attempt to use the App, Gridwise will perform a location check to determine if You are located in an area that Gridwise services. Gridwise may also use geofencing technologies to alert You to specialized rideshare rider demand and related information when You enter a particular geographic area. Depending on Your App and device settings, Gridwise may collect Your location data when the App is open on Your device screen and when the App is off screen and running in the background in order to infer the distance You drive and enable features such as location-related notifications.
  • Technical and Device Information: When You use the Service, Gridwise automatically receives the URL of the site from which You came and the site to which You are going when You leave Gridwise’s Service. Gridwise also receives the IP address of Your computer (or the proxy server You use to access the internet), Your computer operating system and type of web browser You are using, email patterns, Your mobile device, including Your Unique Device Identifier (“UDID”) and mobile operating system, as well as the name of Your ISP or Your mobile carrier.
  • Usage Data: Gridwise also collects information about how You use the Service, including Service performance, clicks, and access dates and times. In addition, if You allow Your device to transmit data on third-party application usage, Gridwise may receive information on Your use of third-party applications.

Information from other sources

  • Your work account data: If You choose to link Your Gridwise account to a work account on a third-party platform, Gridwise may receive information such as address, phone number, vehicle information, license plate number, earnings data, and location data associated with completed work activities.

2. HOW GRIDWISE USES PERSONAL INFORMATION

Gridwise may use personal information to:

  • Operate and provide You with the Service, including to create and maintain Your account, help You track Your earnings, hours, mileage and expenses, and enable You to generate mileage and expense reports.
  • If You choose to link Your Gridwise account to a third-party platform work account, Gridwise uses Your linked work data to provide You with a breakdown of Your earnings by platform (including mileage and deductions), how Your pay compares to the average of other workers in Your area, Your highest-earning days, time blocks, and platforms, as well as automatic mileage tracking.
  • Process Your Gridwise Plus subscription and payments.
  • Provide customer support and respond to Your requests.
  • Deliver You relevant ads and measure their performance, including through the use of cookies and similar technologies.
  • Send You marketing communications about Gridwise features, offers and announcements that may be of interest to You. You may opt out of receiving commercial messages from us through email by clicking on the “Unsubscribe” link contained in each email. Please note that You may continue to receive transactional or account-related communications from us.
  • Send You reminders, technical notices, updates, security alerts and support and administrative messages, and service bulletins.
  • Enforce our Terms of Service, and detect, investigate and prevent fraud, abuse and security incidents, including by analyzing Your account, device and usage information.
  • Comply with legal obligations, respond to lawful requests, and establish, exercise or defend legal claims.
  • Improve the Service, including by tracking use of the Service, analyzing Your needs and interests, and developing or updating Gridwise offers, products or services.
  • Conduct research based on Your responses to surveys that we might ask You to complete.

3. LINKS/POSTINGS TO OTHER SITES

You may access the Service on a third-party website and/or the Service may contain links to other websites. Gridwise is not responsible for the actions, practices, or content of such websites linked to or from any of the Service. You understand that such websites may have their own legal documents to which You must agree prior to using and that Gridwise has no control over these legal documents. As always, You understand that it is Your responsibility to verify Your legal use of a website as well as use of information from the website with the corresponding website owner. Gridwise does not guarantee, approve, or endorse any information, material, services, or products contained on these third-party websites. Gridwise is not responsible for any content on sites linked from or to the Service or for obtaining any necessary consent for such third-party websites to collect, transmit, or otherwise use Your information.

4. HOW GRIDWISE SHARES INFORMATION

  • Gridwise users: If You choose to link Your Gridwise account to a third-party platform work account, Gridwise uses Your de-identified data (i.e., data that does not directly identify You) to generate market insights available to users of the Service, such as earnings benchmarks. These insights are generated from data across multiple users.
  • Analytics customers: If You choose to link Your Gridwise account to a third-party platform work account, Gridwise shares de-identified records of pay, trips, and work activity with third parties, including transportation companies, investors, municipalities, and airports, as part of Gridwise’s analytics offerings. Prior to sharing, Gridwise removes direct identifiers (such as Your name and contact information) and replaces them with a randomized identifier. Trip records reflect pickup and drop-off locations at the neighbourhood level only and do not include precise geolocation or route data. Gridwise does not share Your name, email address, phone number, personal profile information, or continuous location data with any third party.
  • Service providers: Gridwise may share personal information to Gridwise’s service providers that perform services on Gridwise’s behalf, including, but not limited to, operation of the Service technology, data analytics, marketing services, and other related services. Access to Your personal information by such service providers is limited to the information reasonably necessary to perform its limited function for Gridwise. Gridwise also contractually requires that such contractors and service providers: 1) protect the privacy of Your personal information, and 2) not use or disclose Your personal information for any purpose other than providing Gridwise with products and services or as required by law.
  • Other members of the public: Gridwise may share Your username, Your avatar, and a message to Gridwise and other users of the Service at Your request. When You communicate on public forums or to other users of the Service, Your communications, avatar, and username may be viewable by the public.
  • Legal and compliance: Gridwise may share personal information Gridwise collects, as permitted by law, or when required or advised to do so in response to a valid legal requirement to release this information such as a state or federal law, regulation, search warrant, subpoena, or court order; or in special cases, such as in response to a physical threat to You or others, to protect property, or if Gridwise determines such disclosure is legally permissible to defend or assert legal rights or prevent harm, or to defend ourselves in litigation.
  • Transfer of Ownership: Gridwise may share personal information in accordance with Section 6 (“Transfer of Ownership”), below.

5. SECURITY

Gridwise has implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. Gridwise policies limit access to users’ personal information that is collected from the Service, including the App, to Gridwise employees and agents and the employees and/or agents of Gridwise’s affiliates and business partners who need the information to fulfill their business responsibilities, and who are under obligations of confidentiality.

The Service utilizes various information security measures to protect Your personal information, including authenticated network communication, encrypted data transmission and storage, and internal access controls. If Gridwise provides the capability for You to create a user ID and password, You should protect Your user ID and password and NOT share it with anyone. If You believe Your user ID and password have been compromised and You have trouble changing Your user ID/password on the Service, please contact Gridwise’s technical support department at privacy@gridwise.io.

6. TRANSFER OF OWNERSHIP

If the entire or a substantial ownership of the Service were to change, or in the event of a proposed or completed merger, acquisition, sale or transfer of some or all of Gridwise’s assets (including as part of insolvency or bankruptcy proceedings), or as part of a corporate reorganization or other change in corporate control, Your user information, including personal information, may be transferred to the proposed or new owner.

7. CROSS-BORDER TRANSFERS

Gridwise is headquartered in the United States of America, and personal information may be processed by Gridwise or by Gridwise’s affiliates, business partners, merchants, or service providers in jurisdictions such as the United States of America.

8. GENERAL DATA PROTECTION REGULATION (GDPR)

Gridwise does not target or knowingly collect data from users in the EU. Gridwise makes no representations that it is compliant with the European Union’s General Data Protection Regulation (GDPR), nor that it needs to be compliant with GDPR. Your Rights. Subject to limited exceptions under applicable law, You have the right to access, update, rectify and correct inaccuracies in Your personal information and to withdraw Your consent to our collection, use and disclosure of Your personal information. To exercise these rights, You may contact us using the contact information set out in “Contact” below. We may require additional information to verify Your identity.

Your Choices. You have several options for managing how Gridwise collects, uses, and shares Your personal information:

  • Marketing Communications: Where You have consented to receive marketing communications from us, You can withdraw Your consent at any time by clicking the “Unsubscribe” link included at the bottom of each email we send.
  • Linked Account Data-Sharing: If You choose to link your Gridwise account to a third-party platform work account, You can withdraw Your consent to third-party data sharing at any time by emailing support@gridwise.io.
  • Account Settings: You can view and update Your account information and manage Your notification preferences in Settings, where You can also delete Your account.

Service Providers. We and our service providers may access, store and otherwise process personal information outside of Canada or the province/territory where you reside, including in jurisdictions such as the United States. For information about how we or our service providers process personal information outside of Canada, please contact us using the contact information below. We and our service providers may disclose Your personal information if we are required or permitted by applicable law or legal process, which may include lawful access by foreign courts, law enforcement or other government authorities in the jurisdictions in which we or our service providers operate.
